Tanya, here is the thing. In NY (and any other state for that matter) there are laws. Retarded laws for that matter, but laws. I will see if I can't get a location on him and more info., The first thing is to try an talk to this man and see if he would be willing to let the dog finish his years in the house. If that fails the best thing I can do is offer fencing so that the dog is out of that cage and free to roam the yard. I will look into it but can't guarantee a thing. People, have rights whether we like them or not. That just makes it ALL the harder. But people wanting to rush in and steal the dog is just not right. IMO!

Thanks Robin,

I understand Ag & Market law and i know it is not illegal to house a dog this way... but it is cruel no matter what..

This is an e-mail that I received today from Penny, the Dunkirk area rep. I have also talked to her on the phone about it last night. The mess going on with this dog is a LONG one that noone has been able to make headway. From what I understand the owner is a very arrogant jerk....here is the e-mail....

Peppy's lived in a 2 1/2' X 7' pen outside for 15 years--I became aware of her 3 years ago and offered to buy her, walk her, fence in the yard, etc but he owner was stubborn and thinks she has a good life.  I called AC and the cruelty investigator but the situation wasn't illegal so that got nowhere too.  Chris and I contacted others but nothing worked. 

Her living situation is so sad.  She has a metal enclosure for shelter and about 5 feet of a metal grate to stand on.  (The whole thing is off the ground.)  He told me she is a "deer tracking dog" and that he took her out every Saturday to track deer--3 yrs ago anyway--she is probably too old and lame to do so now.  Otherwise, she probably isn't out of the cage more than a couple times a week according to a neighbor.

Recently, I took pictures of her and shared them with a new rescue friend who has sent it to a few sites and many people to try and get help.  Now, Chris and I have been telling her story again.  It seems the bottom line is to either get media attention for this situation (which-this situation is no worse than how puppy mill dogs live) or take her which isn't an option because where she lives is wide open and viewable to a large area.

Edwards says Internet story regarding dog not factual

A story being circulated on the Internet about an abused dog in the city of Dunkirk caught the attention of Chautauqua County Executive Greg Edwards, who then looked into the matter concerning a dog named Peppy.

According to Edwards, the story on the Internet is not factual and Peppy is doing well in her retirement.

“My assistant spoke directly with the director of our Humane Society, who has not only checked on this dog but has received confirmation that this dog is walked on a daily basis and confirmed with the dog's veterinarian that the dog is well cared for, in as good a condition that a 16-year-old Husky could be, is of the proper weight, the feet are in good shape and the dog has been receiving prescription drugs and a supplement to deal with the onset of arthritis,” Edwards said in a press release.

Edwards went on to say Peppy has had but one owner in her adult life and competed as a sled dog until that was no longer possible.

“When I personally visited the owner and his dog (Tuesday) he showed me the Scotts kennel that consisted not only of the mesh area but an insulated dog kennel where the dog was sleeping when I arrived,” Edwards said. “I have many more facts, but rest assured that my office, the Humane Society and other officials take issues like this very seriously and the dog is not being mistreated in any way, shape or form.

“Unfortunately, someone has taken ... to misrepresent the situation and now the owner has been receiving death threats, drive-by harassment and abuse that is totally inappropriate.”
